Forj Software, Inc. (“Forj“, “we“, “our” or “us“) develops and operates an online membership platform (the “Platform”), used by various organizations, associations, businesses, and communities of practice (“Community” or “Communities”) to provide their users and members an online destination where they can network, collaborate, learn and give back to others.     

We also maintain and operate the website http://www.forj.ai and http://www.mobilize.io their subdomains and their related features, such as our blog and newsletters (collectively, the “Site“) as well as the Forj mobile application (the “App“), and access to the Platform is made possible through both (the Platform, together with the Site and App – the “Services“). 

This Privacy Notice describes the personal data we typically receive or collect whenever someone visits our Site or installs and opens our App (a “Visitor“), creates (“Owner“), manages (“Manager”), or joins (“Member“) a Community or Communities, or uses the Platform and engages with other Members of the Community via the various communication features available via the Services. It also describes how and for which purposes we may use such data, where we store and for how long we retain it, with whom we may share it, our use of tracking technologies and communications, our security practices, your choices and rights (whether you are an Owner, Manager, Member or Visitor, “you“) regarding such data, our roles with respect to your data, and how to contact us if you have any concerns regarding this Policy or your Privacy.

Please read this Notice and make sure that you fully understand and agree to our policies and practices regarding your Personal Data. Except as otherwise provided in this Notice, “Personal Data” is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you. “Personal Data” does not include information which is generally not considered “personal data” or “personal information” under applicable law or is otherwise exempted under applicable law, such as information which is publicly available or subject to special data privacy laws and/or regulations, or information not otherwise considered “personal data” or “personal information” under applicable law.

If you do not agree to this Notice, please discontinue and avoid using our Services.

You are not legally required to provide us with any Personal Data, but without it we will not be able to provide you with the full range or with the best experience when using our Services.

1. The Interactions this Notice Covers


This Notice describes and applies exclusively to Personal Data that we collect on or in connection with the Services and in texts, emails, and other electronic communications sent through or in connection with the Services. Except as otherwise provided in this Notice or as required by applicable law, this Notice does not apply to information that is collected by a third party, including through any app or content that may access, be linked to, or otherwise be accessible from the Services. If you visit an app, website, or third party that we mention or link to, please review its privacy notice before providing it with any information, as that privacy notice will apply to your interactions with that application, website, or third party.

2. Data Collection


We collect several types of Personal Data from and about you as a result of your use of the Services or your communication with us. 

This Personal Data is typically collected and generated through your interaction with our Services, through automatic means, or directly from you or your Community Owner or Manager.

We collect the following categories of data, which may include Personal Data:

  1. Data automatically collected or generated: when you visit, interact with, or use our Services, including any e-mail or text messages sent to you via the Services, we may collect certain technical data about you. We collect or generate such data either independently or with the help of third-party services (as detailed below), including through the use of “cookies” and other tracking technologies (as further detailed below). Such data mainly consists of technical and aggregated usage data, such as IP address, data regarding a device, operating system and browser, and user activity on our Services. This data does not enable us to learn a person’s true identity or contact details and serves mostly so we could better understand how our users typically use our Services and how we could improve their user experience, our marketing campaigns and engagements, and the overall performance of our Services.

  2. Data received from you: you may provide us Personal Data when you create your account and Community user profile (as an Owner, Manager, or Member), such as identifiers including your name, workplace or community role, contact details (such as e-mail, phone, and address), profile image, location, gender, and account login details (such as username and passwords) (collectively, “Account Data”), as well as any other data you choose to provide when you visit our Services, post and share content with your Community or other Managers or Members, or when you contact us. Owners or Administrators may also provide us additional Account Data regarding their Community’s information and preferences. To the extent that such information concerns a non-human entity (e.g., a company or business), we do not regard it as “Personal Data” and this Policy shall not apply to it. As the Platform enables Owners and Managers to require or ask their Members to submit additional Personal Data, and as Owners, Managers, and Members may choose to submit additional Personal Data and share it with their Community or certain other Members, the list above is not exhaustive. We will, however, indicate on the Platform, for each Personal Data parameter, if it is “required” or “optional” for either the adequate performance of our Services or per the Community Owner’s or Manager’s requirements.  By using the Services and providing us with information, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Notice.

  3. Member Data received from Community Owners and Managers: Community Owners and Managers may use the Platform to add and invite Members to their Community. When doing so, they may submit such Member Personal Data as listed in paragraph 2 above, in whole or in part. Any Community Owner and Manager doing so are solely responsible to ensure the legal basis and authority for processing such Personal Data, its accuracy and completeness, and for providing sufficient notice and choice to their Members regarding the use of their data. The Community Owner is the “Data Controller” of such data, and Forj solely acts as their “Data Processor.”

  4. Data from Other Sources:  We may receive information about you from other sources, including publicly available databases or third parties from whom we have purchased data, and combine this data with information we already have about you.  This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you.  If you provide us Personal Data about others, or if others give us your Personal Data, we will only use that Personal Data for the specific reason for which it was provided to us

  5. All data is stored in the US.

3. Use of Personal Data


We use Personal Data that we collect about you or that you provide to us:      

  1. in order to provide and improve our Services including services that display posts, account information, documents, reports, and communications such as emails;

  2. in accordance with our contractual obligations towards Community Owners; 

  3. to contact our visitors and users; 

         

  4. to communicate with you and to process your requests, purchases, and payments;

  5. to notify you of changes to any products or services we offer or provide;

  6. to advertise our products to you;

  7. to notify you to participate in interactive features of the Services

  8. to maintain the safety, security, and integrity of the Services, as well as our databases and other technology assets;

  9. to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection purposes;

  10. for testing, research, analysis, and product development, including to understand our audience, develop and improve the Services, as well as our customer service, products, and services, including to create aggregated statistical data or anonymized or pseudonymized data, which we or our business partners may use to provide and improve our respective services;

  11. to respond to law enforcement requests and, as required by applicable law, court order or governmental regulations;

  12. to evaluate, negotiate, or conduct a merger, divestiture, restructuring, reorganization, dissolution, other sale or transfer of some or all of our assets, or the negotiation thereof, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our users and customers is among the assets transferred;

  13. to fulfill any other purpose for which you provide it; and

  14. for any other purpose, with your consent.

4. Disclosure of Personal Data


We may disclose your Personal Data:

  1. to our subsidiaries and affiliates. We may disclose Personal Data internally within our family of companies, for the purposes described in this Notice;

  2. to contractors, service providers, advisors, and other third parties (collectively, “Service Providers”) we use to support our business and who are bound by contractual obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them. Forj remains responsible and liable for any Personal Data processing done by Service Providers on its behalf, other than for events outside of its reasonable control;

  3. to third-party ad network partners in order to assist us in serving you with targeted ads;

  4. to Owners, Managers, and Members of your Community. Once you join a Community, your user profile will be made available to all Owners and their appointed Managers of such Community. All or part of your user profile may also be made available to other Members of a Community you join, according to the discretion of the Owners and Managers of that Community. Please note that Forj is not responsible for nor controls any further disclosure, use or monitoring by or on behalf of your Community Owners, Managers or Members;‍

  5. to an actual or prospective buyer or other successor in the event of a change of control, including a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which case Personal Data held by us about our users is among the assets transferred; 

  6. to comply with any court order, law, or legal process, including to respond to any government or regulatory request;

  7. we may disclose or allow government and law enforcement officials access to certain Personal Data, in response to a subpoena, search warrant, or court order (or similar requirement), or in compliance with applicable laws and regulations, including for national security purposes. Such disclosure or access may occur with or without notice to you if we have a good faith belief that we are legally compelled to do so, or that disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing;

  8. for any other purpose disclosed by us when you provide the Personal Data;

  9. for the removal of doubt, Forj may disclose your Personal Data in additional manners, pursuant to your explicit approval, or if we are legally obligated to do so, or if we have successfully rendered such data non-personal and anonymous. We may transfer, disclose, or otherwise use aggregate data, anonymized data, or data that does not constitute Personal Data at our sole discretion and without the need for further approval.‍     

5. Links to Other Websites


Our website includes links to other websites whose privacy practices may differ from those of Forj.  If you submit information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

6. Cookies and Tracking Technologies


Forj uses certain monitoring and tracking technologies, such as cookies, beacons, pixels, tags, and scripts (collectively, “Cookies”). These technologies are used in order to maintain, provide and improve our website and services, and in order to provide our users with a better experience (for instance in order to track users’ preferences, to better secure our services, to identify technical issues, and to monitor and improve the overall performance of our services).  We request your consent prior to using any Cookies that are not essential for the basic function of the Services.

  1. What are Cookies?

    Cookies are small text files that are stored by the browser (for example, Google Chrome, Microsoft Edge, or Safari) on your computer or mobile device. They allow websites to store things like user preferences. You can think of Cookies as providing a ‘memory’ for the website so that it can recognize you when you come back and respond appropriately.

  2. How does Forj use Cookies? 

Essential Cookies: These Cookies are essential for the Services to function and cannot be switched off in our systems. You can set your browser to block or alert you about these Cookies, but some parts of the Services may then be inaccessible or not function properly.

Performance Cookies: This type of cookie remembers your preferences for tools found on the services, so you don’t have to re-set them each time you visit.

Analytics Cookies: Every time someone visits our services, analytics services we use generate Cookies which can tell us whether or not you have visited the services in the past, and provide additional information regarding how our users use our services (such as regarding where users tend to click on our services). Your browser will tell us if you have these Cookies and, if you don’t, we generate new ones. This allows us to track how many individual users we have and how often they visit the services. Unless you are signed in to our services, we cannot use these Cookies to identify individuals. We use them to gather statistics. For example, the number of visits to a page.

Session Cookies: When you register and sign in to our Services, we generate Cookies that let us know whether you are signed in or not. Our servers use these Cookies to work out which account you are signed in with and if you are allowed access to a particular service. While you are signed in to our services, we combine information from your registration Cookies with analytics Cookies, which we could use to identify which pages you have seen.

Advertising Cookies: These Cookies allow us to know whether or not you’ve seen an ad or a type of ad, how you interacted with such ad and how long it is since you’ve seen it. We also use Cookies to help us use targeted advertising. We may use Cookies set by another organization, so we can more accurately target advertising to you. We also set Cookies on certain other sites that we advertise on. If you receive one of those Cookies, we may then use it to identify you as having visited that site if you later visit our services. We can then target our advertising based on this information.

Third-Party Integration Cookies: On some pages of our services, other organizations may also set their own cookies. They do this to track the performance of their applications that are integrated with our services, or to customize their services for you. Because of how cookies work, our website cannot access these cookies, nor can the other organization access the data in cookies we use on our services.

    C. Cookies Source & Description

Forj.ai Performance & Registration: Performance cookies are cookies used specifically for gathering data on how visitors use a website, which pages of a website are visited most often, or if they get error messages on web pages. These cookies monitor only the performance of the site as the user interacts with it.

Twilio Segment: We use Segment services to analyze user action when visiting our website.  This makes navigating and interacting with our websites more efficient, easy and meaningful for the user.

Zendesk Third Party Integration: We use Zendesk cookies and integration to provide a support widget in the platform. This plug-in will determine which community you are logged into to help us identify you to solve your issues and ask you fewer questions.

Branch.io Third Party Integration: We use Branch.io to provide deep links for the mobile app. users of our platform.  This provides mobile app. users an experience that matches the web experience.

HubSpot:  We use HubSpot to help us understand how people use our website and to make your experience better. HubSpot sets cookies that let us see things like which pages you visit, how long you stay, and what content you find helpful. This helps us improve the website and send you more relevant information, if you've signed up to hear from us.

Google Search: We use Google Search to help people find our website more easily. When you come to our site through a Google search, Google may place cookies that help them understand how their search services are working and how people interact with the results. These cookies can track things like which search terms led you to us or which pages you visit after clicking a link.

RB2B:  We use RB2B to help us understand how visitors interact with our website and to enhance your experience. RB2B sets cookies on our site that allow us to identify anonymous visitors and gather information such as your location, the pages you visit, and how you found our website. This helps us improve our content and reach out to you with relevant information if you've opted in.

All modern browsers allow you to change your cookie settings. You can usually find these settings in the ‘Options’ or ‘Preferences’ menu of your browser. In order to understand these settings, the following links may be helpful, or you can use the Help option in your browser for more details.

7. Your Privacy Choices


If you are a resident of certain jurisdictions (e.g., European Economic Area), you may have additional rights and choices regarding your Personal Data. Please see Section 14 (Notice for United Kingdom and European Economic Area Residents).

8. Communications


We or our partners may send promotional communications, that you can opt-out of receiving. We may also contact you with service-related communications. You will not be able to opt-out of receiving such communications.

Service Communications: we may contact you with important information regarding our Services. For example, we may notify you (through any of the means available to us) of changes or updates to our Services, billing issues, service changes, password-retrieval notices, etc. You will not be able to opt-out of receiving such service communications.

Promotional Communications: we may also send notifications about new services, events, and special opportunities or any other information we think our Owners and Managers will find valuable. We may provide such notices through any of the contact means available to us (e.g. phone, mobile, or e-mail), through the Services, or through our marketing campaigns on any other sites or platforms.

If you wish not to receive such promotional communications, you may notify Forj at any time by emailing us at support-community@forj.ai or by following the “unsubscribe,” “stop” or “change e-mail preferences” instructions contained in the promotional communications you receive.‍

Behavioral Targeting / Re-Targeting:  We partner with a third-party ad network to either display advertising on our website or to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect non-personal information about your activities on this and other websites to provide you targeted advertising based upon your interests.

9. Information Related to Data Collected for through the Forj Platform


Forj collects certain Personal Data under the direction of its clients, and has no direct relationship with the individuals whose Personal Data it processes for this purpose. Forj works with its clients to help them provide notice to their customers concerning the purpose for which Personal Data is collected.

If you are a customer of one of our clients and would no longer like to be contacted by one of our clients that use our Service, please contact the client that you interact with directly.

Forj may transfer Personal Data to companies that help us provide our Service (“Service Providers”). Transfers to subsequent third parties are covered by the provisions in this Notice regarding notice and choice and the service agreements with our clients.

An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data that Forj processes as a Data Processor should direct such queries to the Forj client (the “Data Controller”). If the client requests Forj to remove the data, we will respond to their request without undue delay. To request your information be removed contact Forj Support: support-community@forj.ai.

Forj will retain Personal Data we process on behalf of our clients for as long as needed to provide the requested services to our client. Forj will retain and use this Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

10. Securing Personal Data


We are committed to securing your Personal Data and use many security measures to better protect it. However, as we can’t guarantee absolute protection, we encourage you to be aware of the risk when using the Services or providing us with your Personal Data.

In order to protect the Personal Data we hold, we use industry-standard administrative, physical, and technical safeguards. However, please be aware that regardless of the security measures used, we cannot and do not guarantee the absolute protection and security of any Personal Data stored with us or with any third parties. 

The safety and security of your data also depends on you. Where you have a password for access to certain parts of the Services, you are responsible for keeping this password confidential. Do not to share your password with anyone.

We retain the data we collect for different periods of time depending on the type of data, how we use it, and what choices you make in connection with your data. We retain the data we collect as long as is necessary for the purposes of use described in this Policy and generally as long as required for ongoing transactions and services requested by you, our legitimate business purposes, and as permitted by law. 

11. Retention of Personal Data


We retain your Personal Data only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws or until you withdraw your consent (where applicable). 

To determine the appropriate retention period for your Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we use your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.

12.Children’s Data 


As a business service, Forj does not target its offerings toward, and does not knowingly collect any Personal Data from users under 16 years of age. If you believe your child has provided us with Personal Data without your consent, contact us as provided in Section 17.  If we learn that we have collected any Personal Data in violation of applicable law, we will promptly take steps to delete such information and terminate the child’s account.

13. Changes

We reserve the right to review and revise this Policy from time to time, without prior notice, subject to applicable legal requirements to notify you or obtain your consent. The date this Policy was last reviewed and/or revised is noted at the top of the page. You are responsible for periodically visiting the Site and this Policy to check for any changes. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

14. EU Residents and UK Residents

If you are a resident of the European Economic Area (“EEA”) or the  United Kingdom, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data.

This Notice for Individuals Located in the United Kingdom and European Economic Area applies exclusively to Visitors and users of the Services who are located in the United Kingdom, European Union, and/or European Economic Area (“Data Subjects”).

Our lawful basis for processing your Personal Data is your consent for, as the case may be, performance of your contract with us, the steps prior to your entering into a contract with us, our legitimate business interest or the legitimate interest of our affiliates or other third parties in the activity described above, or for our compliance with a legal obligation.

If you are a Data Subject, you have the following rights:

  1. Access. You have the right to request copies of your Personal Data. If you require more than one copy, we may charge you a reasonable fee;

  2. Rectification. You have the right to request that we correct any Personal Data that you believe is inaccurate, or to complete any Personal Data which you believe is incomplete;

  3. Deletion. You have the right to request that we delete your Personal Data, under certain circumstances (“the Right to be Forgotten”);

  4. Restrict Processing. You have the right to request that we restrict the processing of your Personal Data, under certain circumstances;

  5. Object to Processing. You have the right to object to our processing of your Personal Data, under certain circumstances;

  6. Data Portability. You have the right to request we transfer data that we have collected to you or directly to another organization, under certain circumstances;

  7. Withdraw Consent. You have the right to withdraw your consent, explicit or otherwise, at any time if we rely on your consent as the legal basis for our processing.

15. Updates and Amendments


We may update this Privacy Policy to reflect changes to our information practices or due to changes in applicable law. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this website prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
